Fresno (UP) - District Attorney James M. Thuesen said he will appeal to Attorney General Robert W. Kenny for legal means of seizing stored farm equipment owned by interned Japanese in the state.

Thuesen's announcement followed the refusal of a Japanese evacuee at the Tulelake War Relocation center to sell his potato digger and planter to Ed F. Loescher, a Fresno county farmer who wrote the Japanese suggesting the stored implements be sold to white farmers.

Thuesen said he would appeal to Kenny because he understood no plan for seizing such farm equipment had been worked out, although such legislation was passed in California in 1943.

"The machinery is badly needed," he pointed out. "If we are permitted to seize it, we can dispose of it where it will do the most good."
